What Should I do in Advance of the Adjudication?

The adjudication will be faster, less costly, and less scary for you with some upfront work. For example:

  1. There are records you can begin to assemble or data that you can collect now that will help you defend your water right.

  2. Your right may span your property and your neighbors’. Agreeing how the right is divided and formalizing that ahead of time will streamline your review.

  3. You may have compliance issues that Adjudication Court won’t resolve, including water uses outside your water right authorization. Knowing, and potentially resolving, these issues before the adjudication is advised.

  4. You may have underuse that creates relinquishment risk, but a relinquishment exception may apply that protects your right. These are highly fact-specific and getting this documentation prepared ahead of time can prevent a loss in your water right.
